Chile - Cell Towers Act

BREATHTAKING: After debating this subject for a decade, the Government of Chile has just passed the "Ley de Torres" or the Towers Act.

It has been reported that the law, approved by a large majority of members of the Chilean Congress,

1) strictly limits the power of antennas,

2) reduces urban impact of towers through ‘infrastructure sharing’,

3) opens up a process for citizen participation in the approval or denial process for new towers at the local level, effectively requiring prior permission, and terms, from local residents prior to receiving municipal permits;

4) allows property owners to request a reassessment of tax valuation for properties, and for communities, where towers are located, to receive compensation from telecom providers in the form of improvement to neighborhood public spaces (described in one article as an amount representing approximately 30% of tower installation costs);

5) and has a retroactive component in that it establishes mitigation measures in areas that are saturated with antennas, including those close to homes or institutions, such as kindergartens, health centers or schools.

The Act has been signed into law by President Pinera and takes effect this week. Chile’s Minister of Transportation and Telecommunications Pedro Pablo Errazuriz stated, "…in addition to protecting the urban landscape and the goodwill of the neighborhoods, the new law takes care of the most important: the health of people in a precautionary manner as recommended by the World Health Organization, setting strict limits on the powers of the antennas. Chile is setting standards in this regard.” We will follow up with more details as we learn them.

Court orders Telecom to remove mast on health grounds

The mobile phone company Entel PCS , was ordered by the Commission of the Appeal Court in Rancagua ( Chile) to dismantle a mobile phone mast in the O´ Higgins district in the town of Santa Cruz.

In a decision that was unanimous, with the defense being undertaken by lawyer Carlos Aranguiz, the public minister Carlos Banados of the first Chamber of the Appeal Court, passed judgment, in favor of Diego Cardoen Delano, representative of the Cardoen Foundation, who made and presented the demand for the protection of the public.

The judgment established that " with regard to number 1 of article 19, ( right to life and to physical and psychological integrity), number 9 ( right to health protection) and number 8 (right to live in a healthy environment free from all pollution), the installation of the structure violates the constitutional rights, of the political Constitution of Chile ".

The decision taken by the Court, indicates that they are two specific factors, in the appeal that led to this injunction. The first one, the most important one, is a report from the Institute of Public Health, which acknowledges that human health is damaged by the harmful effects of the radiation that is produced by phone masts.

The second aspect that was taken into account, at the end of the judgment, by the magistrates, was that the installation of this phone mast in the region of Santa Cruz, caused what is called "visual pollution" in a typical landscape that ought to be preserved.

This exemplary Appeal Court´s judgment is quite significant since it tells the public, that authorities are openly admitting that relay antennas may carry risks to public health. It is hoped that many more judgments of this type will occur in many others countries in the world for the protection of the health of the public.

De la mano del desarrollo tecnológico aumenta la exposición a la contaminación electromagnética, acentuada por la creciente expansión de telefonía móvil. Preocupan cada vez más los peligros asociados a la exposición a radiaciones provenientes de redes eléctricas -alta tensión y domiciliarias- y antenas de telefonía móvil, entre otras. Pueden provocar efectos en la salud, como alteraciones en el sistema nervioso central y ciertos tipos de cáncer. En Chile existen normas técnicas y de seguridad para la instalación de antenas, pero no se asegura, como señala la Constitución, "un medioambiente libre de contaminación" ni hay regulación jurídica.

El fracaso de políticas y normas ambientales que previenen la degradación de los ecosistemas y dan solución a problemas de salud pública, ha forzado a la comunidad a adoptar nuevos enfoques. Así ocurrió con el deterioro de la capa de ozono. Se comenzó a hablar del asunto mucho antes que se comprobara que el problema se debía a la liberación de ciertas sustancias químicas. "La amenaza era tan grave, que la comunidad internacional no podía quedarse quieta esperando el consenso de los científicos", dice Valentina Durán, investigadora del Centro de Derecho Ambiental de la Universidad de Chile.

Principio de precaución El caso de las antenas de telefonía y de celulares es similar. Su tecnología ha llegado a millones y es una de las empresas con mayor ritmo de expansión. Los usuarios aumentaron un 137 por ciento en los últimos cinco años: 1747 millones de celulares en el mundo, según la Unión Internacional de Telecomunicaciones (UIT). Las estadísticas se dieron a conocer en la Cumbre Mundial de la Sociedad de la Información (CMSI), realizada recientemente en Túnez. Pero los efectos podrían incluir tumores, cáncer y leucemia, entre otras enfermedades.

Movimientos ciudadanos se han opuesto a la instalación de antenas y torres de alta tensión y presentan recursos judiciales que la mayoría de las veces no son acogidos. Cualquier norma a implementar debiera ser transparente, permitir la participación ciudadana como una herramienta jurídica, asegurar el acceso a la información y proteger la salud de la población y el medioambiente. Los vecinos exigen una mayor fiscalización, la prohibición de nuevas instalaciones y el respeto a la propiedad y a los planos reguladores. En el mundo hay una creciente tendencia a legislar sobre el tema: "Las normativas se centran en otorgar protección sanitaria a los ciudadanos frente a los efectos adversos conocidos para la salud. Los efectos menos probados han sido tomados en cuenta sólo por algunas normativas, expresamente sobre la base del principio de precaución. Es el caso de Suiza, Italia, Australia y Nueva Zelanda", agrega Valentina Durán.

Explica que podría provocar esclerosis lateral amiotrófica, Alzheimer, dermatitis, enfermedades alérgicas, asma bronquial, aumento de incidencias de abortos, alteraciones neuroconductuales, cardíacas y endocrinas, entre otras. Al investigar las muertes causadas por arritmia e infarto agudo del miocardio se ha establecido que hay relación con la exposición acumulativa a este tipo de contaminación. Pero aún los científicos no se ponen de acuerdo. "Existe evidencia experimental de efectos biológicos asociados a la exposición a radiaciones electromagnéticas. Algunos de estos efectos, descritos en trabajos experimentales y en estudios epidemiológicos, han sido interpretados como evidencia de que exposiciones prolongadas a campos electromagnéticos de baja intensidad son potencialmente nocivas", dice Tchernitchin. No obstante, numerosos científicos aún no admiten esta posibilidad. La controversia se explica, agrega, por la alta variabilidad en la población bajo estudio: "El desarrollo del cáncer por exposición a radiaciones electromagnéticas es un efecto diferido, es decir, se desarrolla después de un período de latencia que puede durar muchos años. En el caso de los teléfonos celulares y de las centrales de retransmisión, la información es insuficiente por su limitado tiempo de uso. Aún así, debiera aplicarse el principio precautorio. Se trata de un caso paradigmático, por cuanto existe desacuerdo en la comunidad científica acerca de los efectos en la salud de los distintos grados de exposición a la radiación. Además, hay temor y desconocimiento en la ciudadanía, que se manifiesta en el rechazo que provocan las instalaciones de antenas y torres".

El principio de precaución fue reconocido en el protocolo sobre seguridad de la biotecnología, del Convenio sobre la Diversidad. Ha sido incorporado en las legislaciones de Suiza, Australia, Alemania, Canadá, Francia, Holanda, Nueva Zelanda, Suecia, Brasil, Colombia y Ecuador, entre otros. Chile no lo consagra en las políticas ambientales, a pesar de los tratados internacionales que han sido ratificados como la Convención de Viena para la Protección de la Capa de Ozono, el Protocolo de Montreal, la Convención de la Biodiversidad y la Convención de Cambio Climático. La Declaración de Río sobre el Medio Ambiente y el Desarrollo (1992), señala: "Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades. Cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente".

Graves efectos para la salud La contaminación electromagnética debiera regularse a través de normas de emisión. Existe una instalación indiscriminada de antenas de celulares. Según expertos, la emisión de un celular supera tres millones de veces la radiación natural. El español Carlos Requejo, geobiólogo, dice que la radiación electromagnética acelera las ondas cerebrales al límite del estrés y puede tener otros efectos biológicos: "En ausencia de normativas, las compañías aprovechan el vacío legal. Las antenas repetidoras de la red móvil proliferan. Muchos informes científicos alertan sobre los riesgos de la radiación electromagnética, especialmente microondas, emisiones de televisión, radares y telefonía móvil, pero también en informática -chips- y múltiples dispositivos electrónicos". Según Requejo, la exposición continua a celulares o antenas repetidoras provocaría daños en la membrana celular, efectos sobre el sistema inmunitario con pérdida de defensas y alteración del ADN.

Se ha relacionado el uso de celulares al incremento de tumores, cáncer de piel y tumores cerebrales. También se lo vincula al Parkinson y al riesgo de acelerar la aparición de Alzeimer. Un estudio del doctor Hyland, de la Universidad Británica de Warwick, afirma que las ondas utilizadas por los celulares son de la misma frecuencia que las ondas cerebrales Alfa.

Según Tchernitchin, "debemos prevenir e informar a las personas que los celulares, hornos microondas y hasta el monitor de su computador son un factor de riesgo para su salud. En Chile somos muy descuidados y no tenemos regulaciones. Algunos de los microondas que se venden aquí, han sido rechazados en Europa y Estados Unidos por no cumplir las normas de seguridad". Un microondas puede generar radiaciones mil veces mayores que la de un celular.

Un estudio llevado a cabo en California concluyó que la leucemia en niños, cáncer cerebral en adultos, problemas cardiacos y suicidios, tenían como factor de causa-efecto las radiaciones electromagnéticas. Otros científicos señalan que menores de 18 años no debieran usar celulares, pues la radiación traspasa la corteza cerebral.

El celular se ha instalado en la sociedad de consumo y cada teléfono tiene una vida útil de un año y medio. En el mundo más de 500 millones entran en desuso cada año, generando unas 250 mil toneladas de residuos peligrosos y sustancias químicas que se acumulan en el medioambiente. En Chile no hay cifras fiables.

Por otra parte, se sabe que se han instalado algunas antenas en patios de colegios y jardines infantiles. En 2001, superaban las 1400, cifra que aumentó a 3000 en 2003. Hoy existen unas 4000. Según la subsecretaría de Telecomunicaciones (Subtel), a fines de 2004 los usuarios de celulares en nuestro país bordeaban los nueve millones.

Las protestas aumentan. En el sector Las Acacias, en La Florida, los pobladores se enfrentaron a Carabineros por la instalación de una antena. Ya había otras dos en el barrio. En Arica ocurre algo similar en la población Raúl Silva Henríquez, donde se instaló una antena en la parroquia. En Macul brotaron cerca de treinta antenas en sólo un año. Es que las compañías ofrecen hasta 600.000 pesos mensuales. Subtel las autoriza y avisa de las obras a la municipalidad. Sólo se fija en aspectos técnicos y la ubicación se rige por la Ordenanza General de Urbanismo. Presentan los planos a la Dirección de Obras que puede objetar el lugar, pero no mucho más. En el Congreso duerme el proyecto que intenta impedir que se sigan instalando cerca de colegios, iglesias, consultorios y hospitales, y a menos de cien metros de sectores poblados.

La única normativa vigente en Chile es de la Subtel -Resolución 505, del año 2000- que fija una norma técnica sobre "requisitos de seguridad". La resolución fija un límite de emisión -435 uW/cm2- de densidad de potencia. Según Valentina Durán, si se compara con las disposiciones de la Ley de Bases Generales del Medio Ambiente, se concluye que Subtel ha regulado "una materia que no es de su competencia, por lo que persiste el vacío legal. Se debiera incorporar a la legislación el ’principio precautorio’, además de normar la emisión".

Alta tensión, daño invisible El cableado de alta tensión también es un potencial cancerígeno. Chilectra señala que en el promedio de exposición no sobrepasaría los 18,8 miligauss. Pero algunos investigadores aseguran que incluso sobre los 3,0 miligauss es un riesgo serio para la salud. La radiación electromagnética que emana de las torres de alta tensión puede causar leucemia infantil, tumores y cáncer cerebral.

En 1994, el Departamento de Trabajo e Industria de Washington, concedió una demanda de indemnización laboral a favor de un trabajador de la empresa de aluminios Kaiser: el cáncer que padecía fue causado por la exposición a campos electromagnéticos en su trabajo. En 1989, la Oficina de Evaluación Tecnológica del Congreso de Estados Unidos, emitió un informe que advertía que "los campos eléctricos y magnéticos producidos por los sistemas de energía eléctricas pueden conllevar peligros para la salud y causar alteraciones biológicas". Tras algunos estudios, la Agencia de Protección Medioambiental reconoció, en 1990, que es posible que "exista un vínculo entre los campos electromagnéticos generados por los cables de alta tensión y el desarrollo del cáncer". Las autoridades en Chile dicen que no tienen dinero para investigar.

La radiación electromagnética es nociva y a mayor voltaje, aún más. Es mucho más frecuente que haya personas enfermas que viven cerca de los tendidos eléctricos y transformadores de alta tensión. Por años se dijo que el cigarrillo producía cáncer y otras enfermedades. Pero las tabacaleras señalaban que no había pruebas concluyentes, mientras financiaban a algunos científicos para que mintieran. Hoy se sabe que es una realidad".

El límite de seguridad de los campos magnéticos emitidos por las torres de alta tensión es de 2,0 miligauss. Es el recomendado por el Consejo Nacional de Protección Medioambiental de Estados Unidos. En Suecia se han realizado estudios en los que se descubrió que niños expuestos a más de 3,0 miligauss tenían cuatro veces mayores probabilidades de presentar tumores y leucemia. En 1992, el doctor danés Jorgen Olsen advirtió que el riesgo de presentar leucemia infantil, linfoma y tumores cerebrales, aumentaba cinco veces más en las personas "que vivían cerca de una línea de alta tensión, expuestos a radiaciones mayores a 4,0 miligauss". Chile sigue esperando una normativa que regule la exposición a los campos electromagnéticos. No es un problema de salud pública ni está en la agenda de los políticos.

Suiza e Italia han aprobado leyes contra la contaminación electromagnética, protegiendo la salud de quienes residen cerca de torres de alta tensión,
repetidoras de TV y antenas de telefonía móvil, y estableciendo multas para los propietarios de instalaciones que superen la radiación permitida.

normativa proporciona un marco claro y pragmático:
medidas precautorias que mantienen las exposiciones tan bajas como sea técnica y económicamente posible, ante el anuncio científico de que la "exposición crónica a bajos niveles puede ser perjudicial".

El límite suizo es 100 veces más estricto que el permitido por la Comisión Internacional para la Protección contra la Radiación No Ionizante (ICNIRP)
y 150 veces menor que el propuesto por el Instituto Nacional de Normativa de Estados Unidos y el Instituto de Ingenieros Eléctricos y Electrónicos (ANSI/IEEE).
Otros países con normas estrictas son Rusia y China, pioneros en la lucha contra esta amenaza medioambiental.

Aunque aún no se sabe lo suficiente como para afirmar que la radiación no ionizante es segura, los efectos confirmados en la última década son suficientes para avalar el establecimiento de medidas precautorias. Estudios epidemiológicos demuestran que la exposición continua a este tipo de contaminación aumenta el riesgo de cáncer y la degeneración del sistema inmunológico, la melatonina y el calcio en el organismo.

Un informe del Instituto de Ciencias de la Salud y Medioambientales (NIEHS) de Estados Unidos, señaló que los campos electromagnéticos son un
"posible carcinógeno". Decenas de científicos han advertido hace décadas que la potencia generada por antenas de telefonía y de alta tensión puede producir riesgos para la salud, si la población mantiene un contacto directo y prolongado. Organismos especializados han hecho recomendaciones
sobre la exposición a la energía en radiofrecuencias. La radiación de las antenas de telefonía contribuye a la radiación total existente, pero de forma marginal. La mayor cantidad es generada por fuentes como la TV, radio, sistemas de búsqueda, servicios de emergencia, electrodomésticos y redes computacionales. La contribución de las antenas de telefonía sería de sólo un 3 por ciento, pero la cifra va en aumento.

Recientes estudios científicos sugieren que los celulares o estaciones base podrían generar "cambios bioquímicos, fisiológicos o en el comportamiento". "La radiación electromagnética aumenta la proliferación celular, en especial en algunas líneas celulares tumorales, lo que puede contribuir a incrementar el desarrollo de tumores. También puede originar efectos indirectos, como alterar el funcionamiento de marcapasos, alterar la permeabilidad celular, aumentar la proliferación celular como en el cáncer de próstata, etcétera", señala el científico Andrei Tchernitchin.

Informes posteriores al año 2000, denotan "efectos en el comportamiento, patrones de sueño, fisiología y/o sensación de 'bienestar' de las personas".
El año 2003, los científicos Borbély y Huber señalaron que "la exposición a la señal de telefonía móvil podría causar ligeros cambios en los patrones
de sueño y en el electrocardiograma durante el sueño". Los académicos Kramarenko y Tan, ese mismo año, informaron de "cambios en la función cerebral (EEG)" atribuidos al uso de celulares. Haarala, en una investigación de 2000, evidenció "efectos en la memoria a corto plazo".
El 2004, el investigador Maier demostró que "la exposición de voluntarios a radiofrecuencias generadas por teléfonos móviles perjudicó su comportamiento en pruebas de la función cognitiva".
