El Supremo obliga a Iberdrola a retirar un transformador para evitar radiaciones

La sentencia, pionera, servirá a miles de ciudadanos para emprender acciones legales contra las emisiones de ondas electromagnéticas

Nadie hubiera apostado un duro por Francisco Hernández y su esposa cuando en 1997 decidieron enfrentarse en los tribunales contra un gigante de la
energía eléctrica. Tuvieron que hacer las maletas y abandonar su hogar, y esperar 9 años para que la justicia les
diera la razón. Ahora, un auto del Tribunal Supremo ha ratificado las dos sentencias anteriores, una del Juzgado de Primera Instancia nº 6 de Murcia, en
el 2000, y otra de la Sección Primera de la Audiencia Provincial de Murcia, en 2001; y lo que es más importante, sin posibilidad de recurso por parte de Iberdrola.

El auto condena a Iberdrola a alejar el transformador o aislarlo hasta que el nivel de radiación sea cero.
Y, si fuese inviable, a indemnizar a los demandantes con una vivienda de las mismas características y en la misma zona exenta de radiación o con el valor de
la vivienda en el mercado, más una indemnización de 600.000 pesetas por daños morales.

Esta sentencia, que sienta como base el principio de precaución -son las operadoras las que tienen que demostrar más allá de toda duda que su tecnología es
inocua para la salud-, considera probado que la vivienda de Francisco Hernández estaba sometida a una radiación muy superior a la normal y que «si bien es
cierto que no existe prueba actual de daño físico alguno no lo es menos que se puede derivar la existencia de un daño moral que viene constituido y fundamentado en el elemental y normal desasosiego e intranquilidad que surge en unas personas por la posibilidad de que en donde desarrolla los elementos
más esenciales de su vida, esto es en su vivienda, se están produciendo una serie de emisiones que pudieran ser nocivas para salud, tanto de ellos como de sus hijos. Circunstancias todas éstas que tienen un difícil encaje con lo previsto tanto en el artículo 15.1 de la Constitución Española (derecho a la vida y a la integridad física), 18.1 y 2 (derecho a la intimidad personal e inviolabilidad del domicilio) y artículo 45.1 3 del mismo texto legal (derecho a disfrutar del medio ambiente y obligación de reparar los daños causados contra este medio ambiente)», reza la sentencia.

El tribunal, incluso, amplió en la sentencia los argumentos jurídicos de la demandada con la aplicación la Ley General Consumidores y Usuarios (LGCU), Ley
26/1984 de 19 de Julio, tanto por lo que respecta a su derecho como consumidores a la indemnización por los daños y los perjuicios ocasionados, como por
el derecho a la protección contra los riesgos que puedan afectar a la salud o seguridad. Una ley que reconoce el derecho al consumidor a que se adopten medidas puramente preventivas, que no es otra cosa que la casa esté libre de campos electromagnéticos que pudieran ser perjudiciales para la salud.

Esta resolución sienta las bases para la lucha que cientos de comunidades de vecinos han iniciado en los últimos años contra las antenas de telefonía móvil,
los transformadores, las torres eléctricas y las estaciones base tanto en la Región de Murcia como en el resto de España. Sin embargo, el abogado José Luis
Mazón, que se ha encargado de la demanda asegura que «el Tribunal Supremo se ha lavado las manos, porque no entra en los argumentos de fondo ni se pronuncia sobre la contaminación, por lo que no tiene efecto de jurisprudencia», aclara.

we could not imagine that Francisco Hernandez and his wife when in 1997 they decided to face in the courts against a giant of the electrical energy.
They had to leave their home and to wait for 9 years so that justice gave the reason them. Now, a car of the Supreme Court has ratified the two previous sentences, one of the Court of First Instance nº 6 of Murcia, in the 2000, and another one of the Section First of the Provincial Hearing of Murcia, in 2001;
and what is more important, without possibility of resource on the part of Iberdrola.

The car condemns Iberdrola to move away the transformer or to isolate it until the radiation level is zero. And, if it were nonviable, to compensate to
the plaintiffs with a house of the same characteristics and in the same zone free of radiation or with the value of the house in the market, plus an
indemnification of 600,000 pesetas by moral damages.

This sentence, that feels as it bases the precaution principle - they are the operators those that they have to demonstrate beyond all doubt which its
technology is innocuous for the health -, considers proven that the house of Francisco Hernandez was put under a radiation muy.superior.a the normal
one and that "although it is certain that some does not exist present test of physical damage is not it less than can be derived the existence from a moral
damage that comes constituted and based on the elementary and normal uneasiness and disquiet that arises in people by the possibility that in where
develops the most essential elements of its life, this is in their house, a series of emissions that could be injurious for health, as much of them as of their
children is taking place. Circumstances all these that have a difficult embroider with anticipated so much in article 15,1 of the Spanish Constitution (right to the
life and physical integrity), 18,1 and 2 (right to the personal privacy and inviolabilidad of the address) and article 45,1 3 of the same legal text (right to
enjoy the medio.ambiente and obligation to repair the damages caused against this medio.ambiente)", say the sentence.

The court, even, extended in the sentence the legal arguments of demanded with the application the General Law Consumidores and Usuarios (LGCU),
Law 26/1984 of
19 of Julio, as much with regards to his right as consuming to the indemnification by the damages and the caused damages, like by the right to the
protection against the risks that can affect to the health or security. A law that recognizes the right the consumer to that purely preventive measures are
adopted, that are not another thing that the house is free of electromagnetic fields that could be detrimental for the health.

This resolution feels the bases for the fight that hundreds of communities of neighbors have in the last initiated years against the antennas of movable
telephony, the transforming, the electrical towers and the stations base so much on the Region of Murcia like in the rest of Spain. Nevertheless, the lawyer
Jose Luis Mazón, who has been in charge of the demand assures that "the Supreme Court has washed the hands, because he does not enter the bottom arguments nor pronounces themselves on the contamination, reason why does not have jurisprudence effect", clarifies.
