Important!! A legal brief to be sent to the court handling Arthur Firstenbergs court cases, Please join us!
USA Created: 5 May 2014
Please, see this very important message from Dafna Tachover:
I’m writing to ask that your organization be part of 2 briefs I intend to submit in 2 legal actions which are now being heard in a US courts on the issue of electro-sensitivity (EHS). We need a response by May 10th. This will NOT involve any costs to your organization present or future.
It is very important as if these cases lose in the appeal, they will have global adverse effects on the issue of EHS. So we all must help to ensure that Arthur Firstenberg, who submitted the lawsuits will not lose.
This is very important.

Explanation:
Currently there are 2 cases in the US which were submitted by Arthur Firstenberg on the issue of EHS. Arthur has been working for decades to help people with EHS in the US and worldwide. Since there is no EHS organization as such in the US, Arthur is the closest in the US to such an organization. Many EHS people owe him their lives.

Although I am not a party to the cases, I intend to join the proceedings as what’s known as an ‘Amicus curiae’ which means “A friend of the Court’. It is a type of procedure in which someone who is not a party to the case submits a brief to the court which includes information that has a bearing on the case, with the intention of assisting the Court to reach the correct decision.

Usually an Amicus Brief is not submitted by a private person but by organizations that may be impacted by the Court’s decision.

I intend to submit the briefs to make sure the Court understands that EHS is a real, proven, global and urgent problem with a magnitude of an epidemic and that a decision that denies the existence of EHS and the disability rights of people with EHS will have devastating worldwide impact. Clearly, the recent decision of the Israeli Supreme Court will be helpful to us.

For the brief to have an impact on the court, we need it to be submitted on behalf of many national and international organizations.

Any organization which works to warn the public of the harmful effects of wireless technology qualifies.

I ask that your organization join my brief.

What is required to join the brief? Joining the brief only requires: (1) that you give your consent to add the name of your organization to the brief and (2) that you’ll write me a 5-line summary as to the purpose of your organization and why the issue of EHS is relevant to the activity of the organization. I’ll need the summary for the first brief by May 10.

When will the Brief be submitted? The Amicus brief in the first of the 2 cases must be submitted by May 28th, but I need to submit to the Court the list of organizations before May 14, so please respond ASAP.

Please be aware, that this month I have to leave my house and I don’t have a place to move to yet, and therefore I’ll be extremely short of time, so please help as much as you can by giving your consent as fast as possible and also by asking any other organization you know, to join the brief.

A failure of Arthur’s legal actions would mean denial of the existence of EHS, and the rights of people with EHS, and would have a devastating impact. We must all do we can to make sure that doesn’t happen.

The following is a summary of the 2 actions filed by Arthur and for which an amicus brief will be submitted:

An action against his neighbor for nuisance – claiming that her use of wireless gadgets injured him and forced him to leave his house. The lower court ruled that EHS is not a real condition but a psychological problem. The amicus brief will be submitted in support of the appeal of that decision.

An action against the City of Santa Fe and AT&T, on the issue of whether the ADA (Americans with Disabilities Act) and the Constitution are preempted by the Telecommunications Act which states that health concerns should be ignored in a decision to erect an antenna, among other issues.

Please join my brief, we all must do all we can not to lose these cases.
